Case of the prosecution is that on 6.2.2026 at about 7.45 pm, the applicant, who is the nephew of the victim, came to the rental room of the victim situated at Namnakala, Ambikapur and committed rape with her and thereafter fled away. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. The applicant has not committed any offence. He has been implicated in the said crime on the basis of suspicion and there is delay in lodging the FIR. Though it is alleged that sexual intercourse was done forcefully with the victim, however, no injury was found on the victim. The applicant is in jail since 8.2.2026. Therefore, the applicant may be released on bail. 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant has committed forceful sexual intercourse with the victim and when the victim was medically examined, positive sign of intercourse was found. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, particularly considering the allegation levelled against the applicant that he 3 visited the room of the victim, who is his relative and committed sexual intercourse with her and on medical examination of the victim, positive report was found, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Jitendra Pal involved in Crime No.68/2026, registered at Police Station Gandhinagar, District Sarguja for the offence punishable under Section 332 (b) and 64 (1) of the BNS, 2023, is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
