Pursuant to an order issued by the Executive Officer, Gazole Panchayat Samiti on 19th December, 2014 provisionally engaging the petitioners for construction of Individual Household Latrines under Swachh Bharat Mission (Gramin), the petitioners completed the construction successfully and raised bills to the tune of Rs.62,00,000/-. An amount of Rs.5 lakhs has been paid to the petitioners. The remaining amount is due. Learned counsel for the petitioners takes this Court to letters issued by the Executive Officer, Gazole Panchayat Samiti to the Additional District Magistrate, Malda alongwith completion certificate and photographs for payment of the due amount claimed by the petitioners. Despite the petitioners having completed the work successfully and completion certificate being granted in their favour, the due amount is yet to be disbursed. Several representations submitted by the petitioners in this 2 regard have fallen on deaf ears. The petitioners seek disbursal of the due. In view of the above, the District Magistrate, Malda, being the 3rd respondent herein, is directed to provide fund required for disbursal of the dues of the petitioners to the Block Development Officer, Gazole Block and Ex-officio Executive Officer, Gazole Panchayat Samiti, being the 9th respondent herein within eight weeks from the date of communication of this order. Upon receipt of such fund, the 9th respondent shall disburse the same in favour of the petitioners within two weeks thereof subject to the petitioners complying with all requisite formalities. The writ petition is disposed of accordingly. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
