As per the case of the prosecution, the complainant, who is working as Junior Engineer in the Chhattisgarh State Power Distribution Company Limited has made a written complaint with the concerned Police Station regarding 17 PCC poles, 10 stays, 16 pieces 4 pins of cross arms which were found lying on the ground and 3200 meter 30 sq mm ACSR conductor and 30 meter 70 sq mm LT AB cable worth Rs.1,80,582/- being cut and stolen, on the basis of which FIR was registered. Hence, the bail application. 3. Learned counsel for the applicants submits that the applicants are innocent and have falsely been implicated in the present case. He further submits that Applicant No.1 runs a fancy store whereas Applicant No.2 is a labourer and they have not committed any offence. Hence he prays to enlarge the applicants on anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail to the applicants. 5. I have heard learned counsel for the parties and perused the case diary. 3 6. Considering the submissions of learned counsel for the parties and further considering that it is a case of theft and involvement of the applicants and that further recovery of stolen articles is to be made, I am not inclined to grant anticipatory bail to the applicants. 7. Accordingly, the anticipatory bail application of the applicants – Kamlesh Kumar Dhitlahre & Lokesh Kumar Khunte, involved in Crime No.168/2026, registered at Police Station Tilda Nevra, District Raipur (C.G.) for alleged commission of offence punishable under Sections 303 (2), 324 (2) & 3 (5) of the Bharatiya Nyaya Sanhita, 2023 and under Section 3 of the Prevention of Damage to Public Property Act, is rejected.
