Learned advocate appearing for the petitioners submits that the petitioners are in custody for 2 years 2 months (since 29.04.2024) and till date, out of 13 witnesses cited in the charge-sheet, only 5 witnesses have been examined. There is no possibility of the trial concluding in near future. As such, petitioners may be released on bail. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the quantum of contraband (Ganja) seized is 36 kgs. I have taken into account the period of detention of the present petitioners and the fact that some time will be required to take the trial to its logical conclusion. Having considered the period of detention of the present petitioners, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. 2 Accordingly, the petitioners viz., 1. Babusona Das, 2. Sajem Sk. and 3. Mafikul Islam shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 4th Court, Paschim Medinipur. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Paschim Medinipur without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 1400 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
