Learned counsel for the petitioner submits that the petitioner has been falsely implicated. No recovery has been made from his possession. Charge sheet has been submitted. Injuries of the victims are not grievous.
Learned counsel for the State produces the case diary and opposes the prayer. It appears that the alleged incident is a result of prior enmity between two groups of persons. No recovery has been made from the petitioner. The victims have been discharged from the hospital. Their injuries do not appear to be grievous. Charge sheet has been submitted. Upon consideration of the material on record, prayer for anticipatory bail is allowed. Accordingly, in the event of arrest, the petitioner namely Abdus Salam @ Md. Abdus Salam be released on bail upon furnishing bond of Rs.10,000/- (Rupees Ten Thousand only), with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to the conditions laid down under Section 482(2) of the BNSS
2 and subject to further condition that the petitioner shall remain outside the jurisdiction of Samserganj police Station and shall furnish the address where he shall presently reside to the Investigating officer, the Trial Court and the officer in charge of the police station under whose jurisdiction he shall presently reside. The petitioner shall appear before the learned jurisdictional Court and pray for regular bail within two weeks from date. The application for anticipatory bail is disposed of. Case Diary be returned. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
