GP FOR HOME 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14944/2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India by the petitioner seeking the following relief: “…to issue writ, order, direction, more particularly in the nature of writ of mandamus declaring the high handed and illegal action of respondent No.3 in threatening and harassing the petitioner to immediately pay an amount of Rs. 15,00,000/- (Rupees Fifteen Lakhs only) to the 4th respondent in respect to a civil dispute pertaining to plot No.457 in an extent of 100 Sq.yards situated at R.S.N0.29P at Payakapuram, Vijayawada …” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner submitted that the respondent-police are interfering in civil disputes between the petitioner and the unofficial respondent. 4. Learned Assistant Government Pleader for Home submitted the written instructions received from the Sub-Inspector of Police, Nunna P.S., and the relevant portion of the written instructions is extracted hereunder: “It is respectfully submitted that the respondent No.4 lodged a report before the Station House Officer, Nunna Police Station, on 18.05.2026, alleging certain disputes in respect of Plot No. 457 admeasuring 100 square yards situated in R.S. No. 29 (Part) at Payakapuram, Vijayawada. Basing on the contents of the complaint, the respondent police called the petitioner for a preliminary enquiry. Upon conducting due enquiry, it was revealed that the dispute between the 4 petitioner and the 4th respondent pertains to civil rights over the above said property. It is further submitted that, in respect of the said property, a civil suit bearing O.S. No. 160 of 2015 is already pending on the file of the Court of the VII Additional District Judge, Vijayawada, for adjudication. In view of the pendency of the civil proceedings and as the dispute is purely civil in nature, the respondent police have not interfered in the matter, there being no specific direction from the Hon'ble Court to do so. The respondent police, therefore, advised both parties to pursue their remedies before the competent Civil Court and settle the dispute in accordance with law.” 5. Recording the same, the Writ Petition is disposed of. However, the respondent-police are directed not to interfere in the civil disputes without following due process of law. There shall be no order as to costs.
