JUSTICE LALITHA KANNEGANTI - 3 - HC-KAR NC: 2026:KHC:33506 WP No. 18937 of 2026 ORAL ORDER The present writ petition is filed seeking the following prayer: "PRAYER WHEREFORE it is prayed that this Hon'ble Court may be pleased to: a. Issue a writ in the nature of Mandamus or any other appropriate writ directing the Respondent No. 1 to 3 to restrain from erecting the electric tower as well as passing of 66 KV high tension wire over and above the Petition Schedule Properties. b. Issue a writ in the nature of Mandamus or any other appropriate writ directing the Respondent No.1-3 to remove the pit dug in the petition schedule properties. c. Grant such other relief that this Hon'ble Court may deem fit in the facts and circumstances of the matter." 2. It is the case of the petitioners that petitioner No.1 is the absolute owner of the total extent of land measuring 8 acres situated in Sy.No.113/1, 113/2, 113/3, 114/1, 114/2, 114/3 of Kallipura Village, Hangala Hobli, Gundlupete Taluk, Chamarajanagara District. It is stated that petitioner No.2 is the absolute owner of the land measuring 2 acres 25 guntas situated in Sy.No.76 of Devarahalli Village, Hangala Hobli, Gundlupete Taluk, Chamarajanagara District. It is the grievance of the petitioners that the respondents are in the process of installing 'High Tension 66 kV Electric Line' connecting Anga Sub Station to Kannegala Station. It is stated that they are - 4 - HC-KAR NC: 2026:KHC:33506 WP No. 18937 of 2026 setting up electric towers on the petitioners' properties and that the high-tension electric lines are passing over the scheduled properties. It is the grievance of the petitioners that they failed to follow the due process. 3. Learned counsel appearing for the petitioners further submits that if the respondents intend to lay the electric lines, they must follow the procedure contemplated under the Indian Telegraph Act and the guidelines issued by the Central Government from time to time. It is submitted that, without following the procedure, the respondents are laying the high- tension lines and have also dug the land for laying the towers. Hence, there may be a direction to the respondents not to proceed without following the due process of law. 4. Learned counsel Sri.H.V.Devaraju, appearing for respondent Nos.1 to 3, submits that they have already approached the Deputy Commissioner and filed an application. It is submitted that respondent Nos.1 to 3 will obtain the necessary orders and only after obtaining the necessary permission, they will proceed with the work of laying electric lines/towers. - 5 - HC-KAR NC: 2026:KHC:33506 WP No. 18937 of 2026 5. Having heard the learned counsels on either side, perused the entire material on record. Considering the submissions of the learned counsel for the respondents that they have already filed an application before the Deputy Commissioner under the Telegraph Act, this Court deems it appropriate to direct the respondents to follow due process. Hence, this Court is passing the following order: ORDER i. The respondents are directed to follow the procedure under the Indian Telegraph Act as well as the circulars/guidelines issued by the State and Central Governments in this regard. ii. Till then, the respondents cannot proceed with the work. iii. Accordingly, the writ petition is disposed of. iv. All I.As. in this petition shall stand closed.
