08.07.2026 Court No.35. D/L.310. Rakib (Allowed) CRM (NDPS) 1395 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Lake Town Police Station case no. 215 of 2023 dated 08.10.2023 under Sections 20(b)(ii)(c)/29 of the NDPS Act. And In the matter of : Mongal Dan & Anr. ……Petitioners. Mr. Debasis Kar Mr. Arka Tilak Bhadra .....for the Petitioners. Ms. Arushi Rathore Mr. Saswata Chatterjee ……for the State. Learned advocate appearing for the petitioners submit that similarly placed accused persons have been granted bail in CRM (NDPS) 1069 of 2025, CRM (NDPS) 1010 of 2025 and CRM (NDPS) 1036 of 2025. Learned advocate appearing for the state opposes the prayer for bail but is unable to refute the contention relating to locus of the present petitioners being similar with that of the other accused persons who are on bail. Having considered the same, I direct the petitioners namely, Mongal Dan and Guru Hantal be released on bail on same terms and conditions as was imposed upon the other accused persons in CRM (NDPS) 1069 of 2025, CRM (NDPS) 1010 of 2025 and CRM (NDPS) 1036 of 2025.
