Nyaya Sanhita, 2023 (Section 118(2) of BNS added later on), at Police Station Kabarwala, District Sri Muktsar Sahib.
Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and he has no concern with the said incident. He argued that the alleged occurrence took place on 09.01.2026 but the FIR in question was registered on 10.01.2026 i.e. after a delay of 01 day, casting serious doubt on the prosecution story. He argued that the petitioner was neither present on the spot at the time of commission of offence, nor has inflicted any injury to the complainant. He further argued that if the contents of the FIR are taken to be true, even then the injury attributed to the petitioner is on non-vital part and was initially stated to be simple in nature. He further argued that Section 118(2) of BNS was added later by the prosecution only to make the offence graver. Further, co-accused Rani (wife of the petitioner) has already been granted the concession of anticipatory bail by the learned trial Court, vide order dated 19.02.2026. Moreover, the petitioner has clean antecedents as he is not involved in any other case and no recovery is to be effected from him. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and when called upon to do so by the investigating agency.
On the other hand, learned State counsel has already filed the status report in the matter and while referring to the same, he has opposed the prayer for grant of anticipatory bail, by submitting that the allegations levelled against the petitioner are serious in nature.
Adjourned to 06.07.2026.
In the meantime, the petitioner is directed to join investigation within a week from today and would appear as YAG DUTT 2026.07.07 17:55 I attest to the accuracy and authenticity of this
order/judgment.

Learned counsel representing the State of Punjab, on instructions from SI Gurdeep Singh, Polie Station Kabarwala, District Sri Muktsar Sahib, who is present in the Court, submits that in compliance of the order dated 29.05.2026, the petitioner has duly joined investigation and his custodial interrogation is not required.
