1. The petitioner is anticipating arrest in connection with Kotwali Police Station Case No. 364 of 2026 dated 05.05.2026 under Sections 126(2) / 118(2) / 109 / 324(4) / 304 / 3(5) of the Bharatiya Nyaya Sanhita, 2023.

In view of the report of the Medical Superintendent-cum- Vice Principle, MGM Hospital, Coochbehar dated 11th June, 2026 it appears that medical record pertaining to the patient could not be traced by the Hospital. By no stretch of imagination, any cogent material therefore can be found available against the petitioners in absence of the medical documents.
3. In view of such lacuna in investigation so far, the petitioners’ prayer for anticipatory bail is allowed.

It is directed that in the event of arrest of the petitioners, the petitioners shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Coochbehar. The petitioners shall comply with the conditions under Section 482(2) of the BNSS, 2023 and shall cooperate with the investigation in all possible way. They shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
5. C.R.M.(A) 426 of 2026 stands disposed of.
