This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No. 02/2026 registered at Police Station Cyber, District Raigarh (C.G.) for the offence punishable under 2 Sections 318(6), 308(4), 112(2), 61(2) of BNS and Section 66(D) of the Information Technology Act. 2. Case of the prosecution, in brief, is that the complainant, Narendra Singh Thakur, lodged an FIR alleging that he received a phone call from an unknown person claiming to be associated with the TRAI Department. The caller falsely informed him that another Jio mobile number registered in his name was being used for illegal activities and, on that pretext, deceived him into transferring a total sum of Rs. 36,97,117/- through multiple UPI transactions on different dates. On the basis of the said complaint, the police registered the FIR and commenced investigation into the alleged offence of cyber fraud. Hence, the bail application. 3. Learned counsel for the applicant submits that the applicant has not committed any offence and he has been falsely implicated in offence in question. He further submits that no specific allegation has been levelled against the present applicant in the FIR or during the course of investigation. The applicant has been implicated without any specific overt act being attributed to him. The applicant is in jail since 22.04.2026, the applicant has no criminal antecedent, charge-sheet has not been filed and the trial is likely to take some time for its conclusion. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that charge-sheet has not been filed in 3 the present case. He further submits that the applicant allegedly involved in the cyber fraud whereby the complainant was allegedly induced, through a fraudulent phone call impersonating officials of the TRAI Department, to transfer an amount of Rs. 36,97,117/- through multiple UPI transactions. During the course of investigation, the applicant's alleged role in facilitating or participating in the commission of the said offence surfaced, leading to his implication in the case. Therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the nature and gravity of the offence, the material available in the case diary, and the fact that the investigation prima facie reveals the involvement of the applicant in a well-organized cyber fraud involving digital arrest, impersonation of public officials, and cheating the complainant of an amount of Rs. 36,97,117/-, coupled with the memorandum statements, recovery of electronic devices, and the allegation that the applicant shared in the proceeds of the crime, as such, without expressing any opinion on the merits of the case, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of applicant-Raviraj Singh, involved in Crime No. 02/2026 registered at Police Station Cyber, 4 District Raigarh (C.G.) for the offence punishable under Sections 318(6), 308(4), 112(2), 61(2) of BNS and Section 66(D) of the Information Technology Act, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9.
