APHC010636552009 IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) [3560] MONDAY, THE SIXTEENTH DAY OF MARCH TWO THOUSAND AND TWENTY SIX PRESENT THE HONOURABLE SRI JUSTICE SUBHENDU SAMANTA CRIMINAL REVISION CASE NO: 185/2009 Between: 1. THIMMAPPA JAYALAKSHMI,, W/O RAMANNA, R/O LAKEVIEW COLONY, PODALAKUR ROAD, NELLORE DISTRICT. ...PETITIONER AND 1. THE STATE OF AP REP BY ITS PP HYD, rep. by its Public Prosecutor, High Court of A.P., at Hyderabad. ...RESPONDENT Revision filed under Section 397/401 of CrPC praying that in the circumstances stated in the affidavit filed in support of the Criminal Revision Case, the High Court may be pleased to present this Memorandum of Grounds of Crl.R.C., to this Hon'ble Court against the Judgment of the II Addl. J.F.C.M., Nellore, in CC.No. 423 of 1999, dt.31- 10-2008. IA NO: 1 OF 2009(CRLRCMP 226 OF 2009 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to order the release of MOS.7 to 28 in favour of the petitioner / accused in CC.No. 423 of 1999 on the file of the II Addl. J.F.C.M., Nellore, pending disposal of the Crl.R.C., in this Hon'ble Court. Counsel for the Petitioner: 1. A HARIPRASAD REDDY Counsel for the Respondent: 1. PUBLIC PROSECUTOR The Court made the following: -2- CRL.R.C. No.185 of 2009 THE HON’BLE SRI JUSTICE SUBHENDU SAMANTA CRIMINAL REVISION CASE NO: 185 OF 2009 ORDER: 1. Inspite of the matter is being listed under the caption ‘for dismissal’, none appears on behalf of the petitioner. 2. The instant criminal revision case is filed under Sections 397 and 401 of the Code of Criminal Procedure, 1973, challenging the direction in the judgment dated 31.10.2008 passed by the II Additional Judicial Magistrate of First Class, Nellore, in C.C. No. 423 of 1999, wherein the learned Magistrate acquitted the petitioner (A.2) and other accused under Section 248(1) Cr.P.C., however, directed that the material objects be disposed of at the time of disposal of the split-up case in C.C. No. 684 of 2007. 3. I have perused the order passed by the learned Trial Court. 4. On careful observation of the findings, it appears that on various grounds, the case against the petitioner (A.2) and A.4 and the other accused was split up and the case against the petitioner (A.2) and A.4 was numbered as C.C. No. 423 of 1999. The learned Trial Court found the petitioner (A.2) and A.4 found not guilty for the offence punishable under section 420 IPC and acquitted them on the basis of several points for determination. On a careful perusal of the observation of the learned Trial Court, it appears that the Trial Court has specifically decided the grounds of Petition as mentioned by the -3- CRL.R.C. No.185 of 2009 Petitioner, he has also decided on the point for determination. I find no illegality and impropriety in the order itself. 5. Considering the same, I find no justification to interfere with the order of the Trial Court in disposing the material objects. 6. Under the above observation, the instant Criminal Revision Case is dismissed as devoid of merit. Since the Petitioner is not present before this Court, let a copy of this order be served upon the learned Trial Court for ready reference. 7. As a sequel, miscellaneous applications pending, if any, shall stand closed. ____________________________ JUSTICE SUBHENDU SAMANTA Date:16.03.2026 BV
