1. The petitioner is anticipating arrest in connection with Phansidewa Police Station Case No. 443 of 2019 dated 11.11.2019 under Sections 306/34 of the Indian Penal Code, 1860 corresponding to G.R. Case No. 3892 of 2019.
2. The State objects for the anticipatory bail of the petitioner on the ground that the petitioner has been absconding since 2019.
3. Having perused the materials on record and the case diary produced by the State, this Court is of the opinion that the petitioner’s custody for the purpose investigation may not be necessary any further till he cooperates with the Investigating Officer. It is also found that the
2 investigation has also been completed and charge sheet has been filed.
4. Accordingly, the prayer for anticipatory bail of the petitioner is allowed.
5. It is directed that in the event of arrest of the petitioner, the petitioner shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount each, to the satisfaction of the learned Additional Chief Judicial Magistrate, Siliguri. The petitioner shall comply with the conditions under Section 482(2) of the BNSS, 2023 and shall cooperate with the investigation in all possible way. He shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
6. The petitioner shall visit the I.O. once in every fortnight till the trial is commenced.
7. C.R.M.(A) 442 of 2026 stands disposed of.
