This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 4134 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No. 4134 of 2026 was rejected as not pressed. It is next submitted that due to some bona fide reason and the counsel being involved in the election of Bar Association of High Court of Jharkhand, the counsel for the petitioner could not appear before this Court when the case was called out and the same resulted in dismissal of B.A. No. 4134 of 2026. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 4134 of 2026 and unless B.A. No. 4134 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 4134 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 4134 of 2026 is restored to its original file to the stage at which, it was before its dismissal.
