AGP Ms. Mary Datta …for the State. 1. Affidavit of service filed by the petitioner is taken on record. 2. By the present writ petition, the petitioner seeks direction upon the respondent authorities for causing an independent inquiry by a competent authority unconnected with the administration of Bartala Girls’ High School in respect of her complaints dated 10th June, 2026 (Annexure P-5) and 13th June, 2026 (Annexure P-6) pertaining to irregularities disclosed therein. 3. The petitioner contends that she is an Assistant Teacher of Bartala Girls’ High School. On 10th June, 2026 and 13th June, 2026 the petitioner made complaints before the Headmistress of the said school with the allegation of certain irregularities in the implementation of mid-day meal scheme as well as
misappropriation of funds allotted to the school. Recently it has come to the knowledge of the petitioner that in order to intimidate and coerce the petitioner, false criminal case has been lodged under the Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989 against her. Hence this writ petition seeking for enquiry into the allegations made by the petitioner in her complaints dated 10th June, 2026 and 13th June, 2026. 4. Mr. Aniruddha Chatterjee, learned senior advocate appearing on behalf of the petitioner through virtual mode submits that the petitioner being the Assistant Teacher has lodged complaints of irregularities in implementation of mid-day meal scheme as well as misappropriation of funds. Without there being enquiry into such allegations the petitioner has been roped in a frivolous criminal proceedings in order to force her to withdraw such allegation. He seeks that the matter may be relegated to the appropriate authority for causing enquiry into the allegations raised by the petitioner. 5. Mr. Sahasrangshu Bhattacharjee, learned Additional Government Pleader appearing on behalf of the State concedes and submits that the respondent no.10, the West Bengal Board of Secondary Education is the appropriate authority to enquire over the complaints lodged by the petitioner. 6. Despite service none appears on behalf of respondent no.10, West Bengal Board of Secondary Education and 2
respondent no.11, Headmistress, Bartala Girls High School.

In view of the submissions advanced on behalf of the respective parties, Respondent no.10, the West Bengal Board of Secondary Education is directed to cause enquiry with regard to the allegations made by the petitioner in her complaints dated 10th June, 2026 (Annexure P-5) and 13th June, 2026 (Annexure P-6) within a period of 10 weeks from the date of communication of this order. 8. Learned advocate for the petitioner is directed to communicate this order to Respondent no.10, the West Bengal Board of Secondary Education, for necessary compliance. 9. With the aforesaid directions, the writ petition being WPA 14494 of 2026 stands disposed of. 10. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted. 11. Interim order, if any, stands vacated. 12. All connected applications, if any, stand disposed of. 13. There shall be no order as to costs. 14. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 15. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities. (Bivas Pattanayak, J.) 3
