1. Affidavit of service filed by the petitioners in Court today is taken on record.
2. Petitioners are apprehending arrest in connection with Sitalkuchi P.S. Case No. 34 of 2026 dated 26.01.2026 under Sections 329(4)/64/62/115(2)/117(2)/109/3(5) of Bharatiya Nyaya Sanghita, 2023 and corresponding to G.R.Case No. 114 of 2026 and pending before the learned Additional Chief Judicial Magistrate, Mathabhanga, Coochbehar.
3. Allegations made against the petitioners are particularly supported by the injury report as available in CD which discloses having head injury of victim with substantive gravity.
4. Notably however, no specific role of petitioner no. 4 can be found from the materials in CD.

5. For the reason as above, the bail prayer of the petitioner no. 4 is allowed.
6. In the event of arrest the petitioner no. 4 (Rashida Bibi) shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount, one of whom must be local to the satisfaction of the learned Additional Chief Judicial Magistrate, Mathabhanga, Coochbehar in connection with Sitalkuchi P.S. Case No. 34 of 2026 dated 26.01.2026. The petitioner shall comply with the condition under Section 482(2) of the BNSS, 2023 and shall cooperate with investigation in all possible way. He shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever.
7. The bail prayer of the petitioner Nos. 1(Bablu Miah @ Bablu Miya), 2(Rasel Miah @ Rasal Miah, (3) Ashik Miah @ Rakib Hossain are rejected.
8. C.D be returned.
