The petitioner has anticipated arrest in connection with New Coochbehar GRPS Police Station Case No. 33 of 2025 dated 29.7.2025 for alleged offence punishable under Section 21 (C)/29 of the NDPS Act, 1985 corresponding to PTN WBCBO1 PQ000969/2025 pending in the Learned District & Sessions Judge, 2nd Court(NDPS) Act, Coochbehar. 2. Earlier the petitioner’s bail prayer has been found to be infructuous by the Court vide order dated 8.4.2026, for the reason i.e. his name has not come up in the chargesheet. Subsequently, the petitioner has been served with notice under Section 67 of the NDPS Act. 3. The petitioner has prayed for bail on the ground of parity as well as his name having not been appeared in the chargesheet. 2 4. Bail prayer has been objected to on behalf of the State due to the reason that in the chargesheet he has been described as a ‘suspected’ person and his name transpired from the witness’s statement at page 146-147 of the C.D. 5. Having found that search and seizure in the case having been already completed and the other co-accused person having been granted bail, the petitioner’s custodial interrogation may not be necessary. 6. Hence considering as above, the bail prayer of the petitioner is allowed. 7. In the event of arrest the petitioner shall be granted bail upon furnishing a bond of Rs. 10,000/- with two sureties of like amount, one of whom must be local to the satisfaction of the learned District & Sessions Judge, 2nd Court(NDPS) Act, Coochbehar in connection with Police Station Case No. 33 of 2025. The petitioner shall comply with the condition under Section 482(2) of the BNSS, 2023 and shall cooperate with investigation in all possible way. They shall not intimidate witnesses in any manner and shall not tamper with the evidence of the case in any manner whatsoever. 8. C.D be returned. (Rai Chattopadhyay, J.)
