This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No.65/2026 registered at Police Station – Magarlod, District- Dhamtari (C.G.), for the offences under Sections 108 and 85 of BNS. Brief facts of the case are that the Applicant/accused was married to the deceased Nutan Diwan on 12.03.2026 as per social customs. Thereafter, the deceased allegedly committed suicide. On the basis of the complaint and statements of witnesses, it was alleged that the Applicant had subjected the deceased to mental and physical cruelty, due to which she was driven to commit suicide. Accordingly, offences as mentioned above have been registered against the present Applicant. Hence, this application. 3. Learned Counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He further submits that the Applicant is the husband of the deceased and the alleged incident occurred when he objected to her talking with another person, pursuant to which she went to her parental house. It is further submitted that the Applicant had made efforts to bring her back, but she was not happy with the marriage on account of her alleged relationship with another person. He further submits that there was no act of instigation or abetment on the part of the Applicant which could have driven the deceased to take such an extreme step. He lastly submits that the Applicant is in custody since 17.04.2026 and the trial is likely to take considerable time for its conclusion, therefore, he may be 3 enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that within 15 days of the marriage, the deceased committed suicide and the Applicant had allegedly assaulted her by slapping on account of suspicion regarding her illicit relationship. 5. Considering the submissions advanced by learned Counsel for the parties, the nature of allegations, the fact that the deceased had committed suicide within a short span of about 15 days of her marriage with the Applicant, the allegation of cruelty and assault levelled against the Applicant, without further commenting anything on the merits of the case, this Court is not inclined to grant bail to the Applicant. 6. Accordingly, the bail application of the applicant – Kamesh Deewan involved in Crime No.65/2026 registered at Police Station – Magarlod, District- Dhamtari (C.G.), for the offences under Sections 108 and 85 of BNS is hereby rejected. 7.
