This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with POR No. 15/12, 15/10, 15/11, 15/13, 15/12, 15/11, 15/10 and 15/13, respectively, registered at Forest Range Officer (FRO) Sitanadi Udanti Tiger Reserve (Sihawa), District – Dhamtari (C.G.) for the offence punishable under Sections 26(1)(क)(ख)(ङ)(च)(ज) and 52 of the Indian Forest Act, 1927, and Sections 27, 29, 30, 51 and 52 of the Wildlife (Protection) Act, 1972. 2. The prosecution story, in brief, is that the written complainant has made to the concerned Forest Range Officer with intend that the accused persons have encroached the forest land for cultivating and residential purpose and thereafter, they have damaged the forest property due to this, cause a loss to the amount of Rs.16,18,60,590/-, Rs.17,67,51,349/-, Rs.16,46,27,122/- and Rs.15,26,55,423/- to the government, respectively in these cases, and hence, the concerned Forest Guard Officer has registered the offence. Hence, this application. 3. It has been argued by the learned counsel for the applicants that the 16 applicants have been falsely implicated in this case. It is further submitted that there is a total of 166 persons who have been implicated in the present case as accused persons, who are situated adjacent of the forest land, therefore, the prosecution have implicated them only on the the basis of conjecture and surmises, and the applicants are small cultivators and they have constructed temporary bamboo house for residing and living with their family members upon the land in their possession which is adjacent to the forest land. Therefore, he prays for grant of anticipatory bail to the applicants. 4. On the other hand, learned State counsel opposes the bail application and submits that the accused persons have encroached the forest land for cultivating and residential purpose and thereafter, they have damaged the forest property, therefore, the applicants are not entitled for grant of anticipatory bail in this case. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicants, it transpires that there is a total of 166 persons who have been implicated in the present case as accused persons, who are situated adjacent of the forest land, therefore, the prosecution have implicated them only on the the basis of conjecture and surmises, and the applicants are small cultivators and they have constructed temporary bamboo house for residing and living with their family members upon the land in their possession which is adjacent to the forest land, at this stage without expressing any opinion on merits, this Court is of the view that the 17 applicants are entitled to be granted anticipatory bail in this case. 7. 7.
