3.
Learned counsel for the petitioner submits that petitioner was innocent and had been falsely implicated in the case. No recovery was effected from the petitioner. Co-accused namely Gurwinder Singh @ Inder and Sahil Negi had since been allowed regular bail by this Court vide orders dated 06.11.2025 and 06.07.2026 and case against the petitioner is at par with the co-accused. Petitioner was in custody since 21.01.2026. The case was at initial stage and charges were yet to be framed. As such, petitioner, who has clean antecedents, deserved to be enlarged on regular bail.
4. Learned State counsel has opposed the prayer for regular bail arguing that petitioner was not at par with the co-accused Gurwinder Singh @ Inder, who had been allowed regular bail by this Court on the ground that he was not named in the FIR. Petitioner’s named figured in the FIR. Allegations against him were serious and considering his antecedents, he did not deserve to be enlarged on regular bail.
