The present appeal seeks to challenge the Judgment and Award dated 19.10.2019 in MVC No.7396/2018 passed by the learned XVI Addl. Judge, Court of Small Causes & MACT, Bengaluru (hereinafter referred to as the ‘Impugned Award’). By the Impugned Award, the learned Tribunal has awarded Rs.1,69,000/- to the appellant/claimant with interest at 7% per annum from the date of petition till its realisation. 2. The learned counsel for the parties submits that the matter has been amicably settled outside the Court. The learned counsel for the respondent No.1/Insurance Company submits that the Insurance Company is agreeable to an enhancement of Rs.65,000/- with accrued HC-KAR NC: 2026:KHC:20329 MFA No. 3606 of 2021 3 interest thereon at the rate fixed by the learned Tribunal as an offer made by the appellant/claimant, in full and final settlement of all claims. 3. The learned counsel for the appellant/claimant, on instructions from the appellant/claimant, submits that this amount is acceptable to the appellant/claimant. 4. Accordingly, and in view of the consensus between the parties, this Court deems apposite to pass the following: ORDER (i) The appeal is disposed of; (ii) The Impugned Judgment and Award dated 19.10.2019 in MVC No.7396/2018 passed by the learned XVI Addl. Judge, Court of Small Causes & MACT, Bengaluru, is modified, enhancing the compensation by Rs.65,000/- along with interest thereon as awarded by the learned Tribunal; (iii) The respondent No.1/Insurance Company shall deposit the enhanced compensation with Vide Chamber Order dated: 16.04.2026 Pg.No.3 & 4 Retyped & Replaced HC-KAR NC: 2026:KHC:20329 MFA No. 3606 of 2021 4 interest applicable thereon, as awarded by the learned Tribunal, within a period of eight weeks from the date of receipt of a copy of this judgment; (iv) On such deposit of compensation, the same shall be released in favour of the appellant/claimant, on filing of an appropriate application by the appellant/claimant for withdrawal of the enhanced amount. (v) The remaining portion of the Impugned Award of the learned Tribunal remains undisturbed. (vi) The Registry is directed to draw the modified Award accordingly. (vii) The Registry is directed to transmit a copy of this judgment to the concerned Tribunal. (viii) No order as to costs.
