Mr. Rajendra Banerjee and Mr. Rajesh Kr. Shah, learned advocates, appear on behalf of the State. Their appearance may be regularized by the concerned authorities. Learned advocate appearing for the petitioner submits that the petitioner is unnecessarily being detained for 3 years 2 months and 11 witnesses till date have been examined out of cited 17 witnesses in the charge-sheet. Learned advocate for the de facto complainant/private opposite party opposes the prayer for bail. 2 Learned advocate for the State submits that all efforts are being made and earlier the prayer for bail of the present petitioner has been rejected. Further, the present petitioner is not similarly situated as other accused who has been released on bail. Having considered the attending circumstances, at this stage, I am not inclined to release the petitioner on bail. However, the prosecution would complete all the witnesses proposed to be examined by 31st January, 2027. With the aforesaid observations, CRM(M)2764 of 2025 is dismissed at this stage.
