Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 8 months and till date only 2 witnesses have been examined out of the cited 11 witnesses. Learned advocate appearing for the State opposes the prayer for bail and draws the attention of the Court to the medico legal examination as well as the statement under Section 183 of the BNSS. Without going into the merits of the case and having regard to the period of detention of the present petitioner, I am inclined to release the petitioner on bail. Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Chitta Sarkar shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of 2 Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under POCSO Act, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date before the learned trial court and shall not leave the district of Uttar Dinajpur without prior permission of the learned special court. Additionally, the petitioner shall not enter into the jurisdiction of Raiganj Women Police Station till the evidence of the relevant witnesses are over and the petitioner shall be permitted to enter the jurisdiction only with the permission of the learned special court. With the aforesaid observations, CRM(M)1141 of 2026 is allowed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
