BHEEMAVARAM, WEST GODAVARI DISTRICT, ANDHRA PRADESH- 534201 ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ or order or direction more particular in the nature of Writ of Mandamus declaring the action of the Respondents 2 herein, more particularly Respondent Nos.3 and 4 in failing to consider and pass appropriate orders upon the representations dated 02.05.2026, 06.05.2026 and 12.05.2026 submitted by the Petitioner seeking permission to conduct public meeting proposed on 01.06.2026 between 04.00 PM and 08 00 PM at Lutheran High School Grounds, Bheemavaram, and for use of microphone public address systems, as being illegal, arbitrary, unreasonable, violative of Articles 14, 19(1)(a), 19(1)(b), 21, 25 and 26 of the Constitution of India and consequently direct the Respondents to forthwith grant permission for conduct of the proposed meeting to be held on 01.06.2026 between 0400 PM and 08.00 PM at Lutheran High School Grounds, Bheemavaram, and for 17 use of microphoner public address system subject to such reasonable conditions as deemed fit and proper, and pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to Direct the Respondent Nos.2 to 4 herein to permit the Petitioner to conduct public meeting proposed on 01.06.2026 between 04:00 PM and 08:00 PM at Lutheran High School Grounds, 20 Bheemavaram, pending disposal of the above Writ Petition, and pass Counsel for the Petitioner: 1. GP FOR HOME 3 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 14917/2026 ORDER: This writ petition is filed under Article 226 of the Constitution of India by the petitioner seeking the following relief: “…to issue an appropriate writ or order or direction more particular in the nature of Writ of Mandamus declaring the action of the Respondents herein, more particularly Respondent Nos.3 and 4 in failing to consider and pass appropriate orders upon the representations dated 02.05.2026, 06.05.2026 and 12.05.2026 submitted by the Petitioner seeking permission to conduct public meeting proposed on 01.06.2026 between 04:00 PM and 08:00 PM at Lutheran High School Grounds, Bheemavaram, and for use of microphone public address systems, as being illegal, arbitrary, unreasonable, violative of Articles 14, 19(1)(a), 19(1)(b), 21, 25 and 26 of the Constitution of India and consequently direct the Respondents to forthwith grant permission for conduct of the proposed meeting to be held on 01.06.2026 between 04:00 PM and 08:00 PM at Lutheran High School Grounds, Bheemavaram, and for use of microphone/public address system subject to such reasonable conditions…” 2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the respondents herein more particularly the respondent Nos.3 and 4 are not considering the representations dated 02.05.2026, 06.05.2026 and 12.05.2026 submitted by the Petitioner seeking permission to conduct public meeting proposed on 01.06.2026 between 04:00 PM and 08:00 PM at Lutheran High School Grounds, Bheemavaram. 4 4. Learned Assistant Government Pleader for Home, on written instructions, submitted that the land that was chosen by the petitioner for conducting the event is the Lutheran High School Grounds, Bheemavaram, falls within the Survey No.423, Gunupudi Revenue Village, which is classified as Government land belonging to the Bhimavaram Municipality measuring Ac.6.94 cents. However, the Municipal Commissioner, Bhimavaram Municipality vide Roc.No.768/2026/G1 dated 05.05.2026, has communicated to the Deputy Superintendent of Police, Bhimavaram stating that the site belongs to Municipality and is classified as Government land and that the Municipal Authorities have decided not to grant any permission for any events at the above location and has specifically requested that no unauthorized activities be permitted and no permission be issued by the police. Basing on the said communication, the respondent-authorities could not permit the petitioner to conduct the event. 5. However, learned counsel for the petitioner submitted that the petitioner will submit proposal with an alternative venue and sought a direction to the respondent-authorities to consider and take appropriate decision on the said proposal submitted by the petitioner. 6. In view of the above said facts and circumstances, the Writ Petition is disposed of, permitting the petitioner to place the alternative proposal before the respondent by today itself and basing on the said proposals, the respondent-authorities are directed to consider the same and take appropriate 5 steps strictly in accordance with law. The said exercise shall be completed by 29.05.2026. There shall be no order as to costs.
