GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, or direction more particularly one in the nature of Writ of Mandamus declaring the action of the 4th respondent in trying to evict the petitioner from the property admeasuring an extent of Ac.4.18 cents in Sy.No.786, situated in Gudarevupalli village. Piler Mandal, Annamayya District which is subject matter of D-Form patta issued in his name vide A.M.No.460/4/1412, dated 25-10-2012 and also subject matter of Suit O.S.No.181 of 2024, dated 12-02-2026 on the file of the Honourable Principal Civil Judge (Junior Division), Filer, Annamayya District without following due process of law and without issuing any notice is illegal, arbitrary, highhanded and unconstitutional and consequently direct the 4th respondent not to interfere with the petitioner's property …” 2. Heard learned counsel for the Petitioner and the learned Assistant Government Pleader for Revenue Department. 3. Mr. Vutupalli Rajanna, learned counsel for the Petitioner, submits that Respondent No.4 is trying to evict the Petitioner from the property in Sy.No.786, despite a favourable judgment and decree granted by the learned Principal Civil Judge (Junior Division), Piler, in O.S.No.181 of 2024 dated 12.02.2026, without following due process of law and without issuing any notice. 3 4. Sri B. Venkata Satyanarayana, learned Assistant Government Pleader for Revenue, on written instructions, submits that there is a dispute with regard to the survey number. According to him, the Petitioner’s property is not in Sy.No.786 of Gudarevupalli Village, Piler Mandal, but in Sy.No.205/3 to an extent of Ac.5.47 cents. However, Respondent No.4, Tahsildar, Piler, was one of the defendants in O.S.No.181 of 2024 and did not raise such an objection either in his Written Statement or during the proceedings. 5. Be that as it may, there is a judgment and decree in favour of the Petitioner against Respondent No.4 with respect to Sy.No.786 of Gudarevupalli Village, Piler. Respondent No.4 is duty bound to honour the said decree and judgment. If aggrieved, Respondent No.4 has the liberty to file an appeal before the competent Appellate Court. Disputing the survey number at this stage, without availing the appellate remedy, is untenable and cannot be accepted. 6. Having regard to the facts and circumstances of the case, the Writ Petition is disposed of directing the Respondent No.4 not to evict the Petitioner from the subject property in Sy.No.786, admeasuring Ac.4.18 cents, situated in Gudarevupalli Village, Piler Mandal, Annamayya District, which right has been recognized in O.S.No.181 of 2024 by the favourable judgment and decree dated 12.02.2026 passed by the learned Principal Civil Judge (Junior Division), Piler, without following due process of law and without issuing any notice. 4 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ Dr.Y.
