1. Heard Mr. Shiva Shankar Pandey, the petitioner in- person, who has appeared through virtual mode and Mr. Indranil Bhaduri, SC IV for the Opp. Parties. 2. The present contempt case has been filed for alleged non- compliance of order dated 14.06.2018 passed in W.P.(S) No.6544 of 2013, by which following direction has been passed: 3.In the above facts, a direction is issued to the respondent no.7 to ensure payment to the petitioner with effect from 01.05.1989 to November, 2000 which has accrued to the petitioner on grant of R.P.P to him, if already not paid to him. Let this order be complied by the respondent no.7 within a period of 8 weeks. Adjustment

of the amount payable by the State of Bihar may be done between both the States, however, on that ground benefits accrued to the petitioner in the light of affidavit dated 11.05.2018 of the Planning-cum-Finance Department shall not be withheld. 4. The writ petition stands allowed, in the aforesaid terms. 3. Show causes have been filed on behalf of Opp. Parties stating inter alia that the benefits as per the direction passed by the writ Court has already been extended to the petitioner. 4. The petitioner has filed response thereto and agitated the grievance that still lesser pay-scale has been granted to him. Statement has been made that wrong calculation has been made and as such prayer has been made to direct the authority concerned to revise the basic pay- scale of the petitioner at par with one Parmeshwar Dayal Singh and accordingly grant consequential financial benefit, as would be evident from affidavit dated 09.11.2020 filed by the petitioner. 5. This Court having heard learned counsel for the parties is of the view that the contempt court is to go strictly by the direction passed by the writ Court and if there is non-compliance of the order passed by the writ Court then only the jurisdiction conferred under Sections 11 and 12 of the Contempt Acts, 1971 is to be invoked. 2026:JHHC:28069

6. Learned counsel for the Opp.
Parties, referring to the operative part of the order dated 14.06.2018 passed in W.P.(S) No.6544 of 2013, in particular paragraph 2 and 3, has submitted that the present contempt case is the case of disparity with one Parmeshwar Dayal Singh. By way of filing supplementary affidavit, it is stated that all the legally payable amount is paid to the petitioner and no amount is remaining pending against him. Further submission has been made that now the petitioner has modified his claim and makes prayer beyond the order passed by the learned writ Court. 7. This Court, considering the aforesaid dispute is of the view that it is not available for the contempt court to pass further direction by exercising the jurisdiction conferred under Article 226 of the Constitution of India. 8. Considering the aforesaid fact and particularly the fact that
order has substantially been complied with, the instant contempt case is disposed of with liberty to the petitioner to avail the legal remedy by filing writ petition, if so wishes.
9. With the liberty aforesaid, the instant contempt case stands
disposed of.
10. Pending Interlocutory Application, if any, stands
disposed of.
