Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 2 years 2 months and till date, only 2 witnesses have been examined out of 19 witnesses cited by the prosecution. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the post mortem report along with the statement of the eyewitnesses. I have considered the statement of the eyewitnesses and the fact reflects that there was a dispute between the brothers and the wife of the present petitioner at the time when dispute arose between the deceased and the present petitioner, handed over a ‘Hansua’ which was used in assaulting the deceased. The deceased succumb to the injury concerned. There are no criminal antecedents of the present petitioner. Having regard to the manner in which the trial is progressing which would take substantial time to be 2 taken to its logical conclusion and the background of the facts, without entering into the merits of the case further, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Ananda Mandal @ Ananda Mondal shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Malda. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Malda without prior permission of the learned Trial Court. The petitioner shall also not enter the jurisdiction of Gazole Police Station till the evidence of the relevant witnesses is over and only with the permission of the learned Trial Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 1131 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
