For the State Affidavit of service filed on behalf of the petitioner is taken on record. The Panchayat and the private respondents are not represented despite service. Learned counsel for the petitioner submits that the private respondents are raising unauthorised construction in the plot in question without obtaining sanction from the concerned Panchayat and in violation of building rules. On prayer of the petitioner, liberty is granted to submit a comprehensive representation before the Dafarpur Gram Panchayat, being the respondent no. 8B in the writ petition, ventilating his grievance within a week from date. The said respondent shall consider and dispose of the same within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to all concerned including the petitioner and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the parties within a week thereof. 2 In the event the construction raised by the private respondents is found to be illegal/unauthorised, the concerned authority shall take necessary steps in accordance with law. The writ petition is disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
