JUSTICE DEEPAK ROSHAN ----------- For the Petitioner : Mr. Vishnu Prabhakar Pathak, Advocate For the Respondents : Ms. Varsha Ramsisaria, AC to GP-V ---------- 02/ 14.09.2026 The instant writ application has been preferred by the petitioner for following reliefs: (i) For issuance of an appropriate writ(s)/order(s)/direction(s) in the nature of mandamus directing the Respondent authorities to regularize the services of the petitioner, who has been continuously working under the scheme 'Sarva Shiksha Abhiyan' as Para Teacher since 03.03.2010 in State Upgraded Middle School, Renchi, Chandwa (Latehar); (ii) For issuance of an appropriate writ in the nature of mandamus directing the Respondent authorities to release and pay the lawful dues/honorarium of the petitioner for the period he has rendered service for the period starting from 03.03.2010 till date; (iii) For issuance of an appropriate writ(s)/order(s)/direction(s) directing the Respondents to grant all consequential service benefits to the petitioner; (iv) For a direction upon the Respondent no. 3 to duly consider the representation dated 01.04.2026 (Annexure-7) filed by the petitioner to regularize the services of the petitioner and pay the lawful dues/honorarium of the petitioner for the period he has rendered service, and act upon the same in accordance with law. 2. At the outset, learned counsel for the petitioner submits that issue of regularization has been set at rest by the Hon’ble Apex Court in catena of 2026:JHHC:27993 2 judgment. Accordingly, learned counsel submits that interest of justice would be sufficed if the instant application may be disposed of by giving liberty to the petitioner to approach concerned respondents, so that his grievances raised in the writ application can be redressed. 3. Learned counsel for the respondents submits that since counter- affidavit has not been filed, if the petitioner so wishes, he may approach the concerned authorities for redressal of his grievances. 4. Having regard to the limited submissions of learned counsel for the parties, the instant writ application is hereby disposed of by directing the petitioner to file fresh representation before the respondent No. 3. The moment the respondent No. 3 will receive any such representation; he shall take decision in accordance with law and applicable rules and regulations as well as the judgments passed by the Hon’ble Apex Court in the case of Bhola Nath Vs. State of Jharkhand & Ors.1 and Jaggo Vs. Union of India & Ors.2, within a period of eight weeks from the date of receipt of such representation. 5. It goes without saying that if the decision is taken in favour of the petitioner, necessary consequential order be issued within a further period of four weeks. 6. Let it be made clear that if the petitioner is still working, he shall not be disengaged and shall receive his remuneration what he is getting at present. 7.
