1. Heard. 2. This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:-
“10.1 That, the Hon’ble Court may kindly be pleased to direct the respondent authorities to remove private respondents No.5 to 7 from illegal blocked the nistari road for approaching their respective agriculture lands at the earliest, in the interest of justice. 10.2 Any other relief which may be suitable DEEPTI JHA Digitally signed by DEEPTI JHA

Learned counsel for the State submits that on an application filed by the petitioner, a review proceeding has been initiated before the Tehsildar, Bemetara, wherein the matter is fixed for today, i.e., 13.07.2026, suppressing this fact, petitioner has filed this writ petition before this Court under Article 226 of the Constitution of India. 4. When this Court has enquired about the same fact from the learned counsel for the petitioner, he submits that petitioner has not informed about the same to him. 5. I have heard learned counsel for the parties and perused the material available on record.

Considering the aforesaid aspect of the matter, particularly considering the fact that petitioner has deliberately suppressed the material facts in respect of pendency of the Revenue Case No.202603232900016, pending before the concerned Tehsildar, in which, he is also participating, this Court deems fit appropriate to impose the cost of Rs.5,000/- upon the petitioner, which shall be deposited in the account of High Court Legal Aid Committee within a period 15 days. The suppression of fact is a serious matter, whenever petitioner approached before the Court, he should have come with clean hands, which the present petitioner has not done, as such the cost has been imposed upon the petitioner. 7. With aforesaid direction, this writ petition stands disposed of. 8. Interlocutory application(s), pending if any, also stands disposed of. Sd/- (Amitendra Kishore Prasad)
