Learned counsel for the petitioner submits that, against the departmental enquiry and the punishment imposed upon the petitioner vide the impugned order, the petitioner has already preferred an appeal before the competent Appellate Authority. He, therefore, seeks permission to withdraw the present writ petition with liberty to pursue the said statutory appeal. 2. Learned counsel appearing for the respondent has no objection to the aforesaid prayer. He, however, submits that in the event the appeal has already been filed, the same shall be considered and decided by the Appellate Authority in 3 accordance with law, preferably within a period of 45 days from the date of receipt of a copy of this order. 3. In view of the submissions made by the learned counsel for the parties, the present writ petition is dismissed as withdrawn, with liberty to the petitioner to pursue the statutory appeal. It is expected that the Appellate Authority shall decide the appeal, if pending, in accordance with law, preferably within the aforesaid period from the date of receipt of the copy of this order.
