Call for the records in Ex.No.32/2024 on the file of Principal Senior Civil Judge at Devanahalli. - 3 - HC-KAR NC: 2026:KHC:33375 WP No. 19356 of 2026 ii. To issue a writ in the nature of mandamus, direct the Principal Senior Civil Judge at Devanahalli to dispose the I.A.No23 in Ex.No.32/2024 filed by the petitioner vide Annexure-C. iii. Grant such other and further reliefs as are just even including the costs of this petition in the interest of justice and equity.” 2. Learned counsel appearing for the petitioner submits that as an objector, he has filed an application i.e., I.A.No.23 under Order XXI Rule 97 of CPC in the month of March, 2025 and even after the arguments are concluded, till now, the orders are not pronounced on the same and it causes lot of hardship to the petitioner. 3. Having heard the learned counsel for the petitioner, considering the fact that an application under Order XXI Rule 97 of CPC is filed in the month of March, 2025 and till now the orders are not passed, this Court deems it appropriate to pass the following: ORDER (i) The trial Court shall pass appropriate orders on the application i.e., I.A.No.23 within a period of fifteen days from the date of receipt of copy of this order. - 4 - HC-KAR NC: 2026:KHC:33375 WP No. 19356 of 2026 (ii) This Court is not issuing notice to the respondents as no adverse orders are passed against him and disposal of case is in the interest of both the parties.
