The petitioner has been rested from service on the ground that he had been involved in the illegal appointment of certain persons as Assistant Teachers in several schools. This issue was being investigated by the Criminal Investigation Department (CID), pursuant to the directions of this Hon’ble Court. Though the petitioner had been arrested, he is presently enlarged on bail. 3. The petitioner was suspended on May 6, 2025. However, the petitioner cannot be kept suspended for all times to come without there being initiation of any disciplinary proceeding or consequences thereof. 4. I direct the District Inspector of Schools (SE), Purba Medinipur or the appropriate authority designated for considering such matters to consider the representation of the petitioner dated October 8, 2025 in accordance with law and in light of the decision of the Hon’ble Supreme Court of India in Ajay Kumar Choudhary vs. Union of India Through its 2 Secretary & Anr. reported in (2015) 7 SCC 291. The entire exercise should be concluded by August 15, 2026. The resultant order be communicated to the petitioner by August 20, 2026 and consequential steps be taken depending on the order that may be passed. 5. With the afore-stated directions, WPA 28007 of 2025 is disposed of. 6. There shall be no order as to costs. 7.
