Side) ORDER The petitioner / Accused, who apprehends arrest in the hands of the respondent police for the offences punishable under Sections 7(5) and 20(2) of Cigarette and other Tobacco Products Act, r/w Section 123 of B.N.S. in connection with the case in Crime No.591 of 2024, seeks anticipatory bail. https://www.mhc.tn.gov.in/judis CRL OP No. 12686 of 2026 __________ Page2 of 6 2. The case of the prosecution is that on 09.10.2024, at 3.30 am, while the respondent police were engaged in night crime prevention duty, they intercepted a Hyundai Creta car bearing registration No.TN-84-W-1006. At that time, the accused was found in illegal possession of banned tobacco products to the tune of 559 kgs. 3. Learned counsel for the petitioner would contend that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this court and that he is cooperate with the investigation. Hence, he prayed for grant of anticipatory bail to the petitioner. 4. The learned Government Advocate (Criminal Side), reiterated the prosecution case and further submitted that this is a second anticipatory bail petition and the quantity of contraband involved in this case is a huge quantity. It is also submitted that the petitioner has no previous case. Hence, strongly opposed the grant of anticipatory bail to the petitioner. 5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent police and perused the materials available on record. https://www.mhc.tn.gov.in/judis CRL OP No. 12686 of 2026 __________ Page3 of 6 6. Considering the nature of the offence and taking into account the fact that the petitioner has no previous case, and he is ready to cooperate with the investigation, this court is inclined to grant anticipatory bail to the petitioner on certain conditions. 7. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance within a period of fifteen days from the date of receipt of a copy of this order, before the learned District Munsif cum Judicial Magistrate, Arcot on condition that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only), with two sureties each for a like sum to the satisfaction of the respondent Police or the Police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further conditions that: [a] the petitioner and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [c] the petitioner shall report before the respondent police every Saturday at 10.30 a.m., for thirty days and thereafter as and when required for interrogation by the respondent police. [d] the petitioner shall not tamper with evidence or witness either during investigation or trial. https://www.mhc.tn.gov.in/judis CRL OP No. 12686 of 2026 __________ Page4 of 6 [e] the petitioner shall not abscond either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
