JUSTICE HANCHATE SANJEEVKUMAR ORAL JUDGMENT The appellant and respondent No.1 are personally present before the Court along with their respective Advocates and submitted a memorandum of Compromise Petition filed under Order XXIII Rule 3 read with Section 151 of CPC. They have submitted that they have compromised the matter each other amicably on their own will and wish without any undue influence and coercion by any other third party. Therefore, requested to dispose of the appeal in terms of the compromise petition. 2. Their submission is placed on record. - 5 - HC-KAR NC: 2026:KHC:32582 RFA No. 838 of 2026 3. To the compromise petition, the appellant and respondent No.1 have put their respective signatures and the Advocates for both the parties have also put their respective signatures. The compromise petition reads as under: ” Under Order XXIII Rule 3 Read with Section 151 of CPC, the above named appellant and the respondent No.1 beg to state as follows:- 1. The appellants submit that the dispute between the parties is amicably settled with the intervention of elders and well wishers. Hence, they have entered into compromise on the following terms and conditions. 2. The appellant submits the respondent No.1 has agreed to grant 3 months time for the appellant to vacate the premises from today. The appellant undertake clear all electric and water dues upto date without damages to the schedule property. 4. The appellant submits that the respondent No.1 herein have no objection to appellant to collect the court fee which will be returned by this Hon'ble Court as per law. 5. The appellant and respondent No.1 have agreed to the above said terms and the respondent No.1 hereby acknowledges the payment of the amount as - 6 - HC-KAR NC: 2026:KHC:32582 RFA No. 838 of 2026 aforesaid. The respondent hereby agreed that, he has no any further claim in respect of the above matter. 6. The parties to this appeal have agreed to end all the litigations against each other, the parties to co-operate to withdraw, quash all civil cases against each other. 6(a) If appellant fails to vacate on or before 1.10.2026, the respondent No.1 can execute the decree as per law. 7. All the parties have entered into this compromise petition, out of their free will and volition without there being any manner of threat, force coercion, undue influence etc., from any quarters. Wherefore, both the appellants and respondent No.1 prays that this Hon'ble court may be pleased to record the above said compromise and dispose off the case, in the interest of justice and equity." 4. Accordingly, the appeal is disposed of in terms of the compromise petition. 5. Draw the decree accordingly. 6.
