Accused No.6 in SC No.5046/2025 pending before the Court of IV Additional District and Sessions Judge, Shivamogga, sitting at Bhadravathi, arising out of Crime No.91/2025 registered by Hosamane Police Station, Shivamogga, for the offences punishable under Sections 103(1), 189(2), 189(4), 191(2), 191(3), 190, 238 and 54 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.91/2025 was registered by Hosamane Police Station, Shivamogga, for the aforesaid offences against Sachin and others based on the first information dated 06.05.2025 received from Deepak @ Sanna Kosu, who is the brother of deceased Arun Kumar @ Dodda Kosu. In the said case, petitioner herein was arrested on 07.05.2025 and remanded to judicial custody. After completing investigation, - 3 - HC-KAR NC: 2026:KHC:34307 CRL.P No. 7448 of 2026 charge sheet has been filed against 12 persons and petitioner is arraigned as accused No.6 in the charge sheet. His bail application filed before the Trial Court in SC No.5046/2025 was rejected on 16.12.2025. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that accused Nos.1, 2 to 4, 8 and 9 were present at the spot of crime. The allegation of assaulting deceased Arun with a knife is found as against accused No.1. Accused Nos.2 to 4, 8 and 9 allegedly had surrounded the deceased and prevented him from escaping and also had assaulted him with their hands. The allegation against accused Nos.5 to 7 is that they had abetted the other accused to commit the crime. It is brought to the notice of this Court that accused Nos.2, 3, 5, 7, 8 and 10, have been granted regular bail by this Court in Crl.P.Nos.16831/2025 C/w Crl.P.No.17383/2025 and 17585/2025, Crl.P.No.168/2026 and Crl.P.No.14503/2025. The allegation against the petitioner and accused Nos. 5 and 7, who have been granted regular bail by this Court in the present case is similar. Under the circumstances, petitioner is also entitled for regular bail on the ground of parity. Accordingly, the following order:- - 4 - HC-KAR NC: 2026:KHC:34307 CRL.P No. 7448 of 2026 5. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.5046/2025 pending before the Court of IV Additional District and Sessions Judge, Shivamogga, sitting at Bhadravathi, arising out of Crime No.91/2025 registered by Hosamane Police Station, Shivamogga, for the offences punishable under Sections 103(1), 189(2), 189(4), 191(2), 191(3), 190, 238 and 54 of BNS, 2023,subject to the following conditions: a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR NC: 2026:KHC:34307 CRL.P No. 7448 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
