PUBLIC PROSECUTOR The Court made the following: 2 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI CRIMINAL PETITION NO: 4550 of 2026 Order: This Criminal Petition, under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), has been filed on behalf of the petitioner herein/accused to grant anticipatory bail in connection with Crime No.40 of 2026 of Cumbum Town Police Station, Markapuram District, registered for the offence punishable under Section 69 of BNS. 2. Case of the prosecution, in brief, is that the complainant lodged a report on 07.04.2025 stating that she is presently working as a contract Female Nursing Orderly at C.S. Puram PHC. She is the daughter of Balu Naik and Anji Bhai. In the month of March, 2023, while attending constable coaching at Guntur, the accused, who is a resident of Jangamguntla Village and Mandal, promised to marry her and, believing the same, she entered into a relationship with him. On such false promise, the accused allegedly had physical relations with her on multiple occasions. Subsequently, the accused was selected as a BSF Constable and is presently working in Tripura. Even thereafter, during his visits on leave, he continued the relationship with the complainant. Recently, when the complainant became pregnant and requested the accused to marry her, he refused and blocked her phone number. 3. Heard Sri T. Sai Surya, learned counsel for the petitioner and learned Assistant Public Prosecutor representing the respondent/State. Perused the record. 3 4. Learned counsel for the petitioner submits that, as per the complaint itself, the relationship between the de facto complainant and the accused was consensual in nature. It is further contended that the de facto complainant is a married woman and, therefore, the allegations made in the complaint would not attract the provisions of Section 69 of the Bharatiya Nyaya Sanhita, 2023. Hence, he prayed for grant of anticipatory bail to the petitioner. 5. Learned Assistant Public Prosecutor, while making submissions, stated that as per the CD Part-II statement of LW.2/victim, she was married to one Chatla Kotesh Babu on 26.10.2019. 6. Considering the relationship between the de facto complainant and the petitioner for the past four years, the allegations levelled against the petitioner, and the statement of LW.2/victim that she is married to another person on 26.10.2019, this Court is inclined to consider the plea of the petitioner for grant of anticipatory bail, subject to the following conditions: (a) The petitioner/accused is directed to surrender before the Station House Officer, Cumbum Police Station, Markapuram District, within a period of two (2) weeks from today and on such surrender, the petitioner/accused shall be released on bail on furnishing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties for a like sum each to the satisfaction of the Station House Officer, Cumbum Police Station. (b) The petitioner/accused shall appear before the Investigating Officer, twice in a month i.e., on every 2nd and 4th Sunday between 10.00 AM and 01.00 PM for three (03) months or till filing of the charge sheet, whichever is earlier. 4 (c) The petitioner shall make himself available for Investigation/interrogation by a police officer as and when required (d) The petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. (e) The petitioner shall scrupulously comply with the above conditions, and breach of any of them will be viewed seriously. The Prosecution is at liberty to move an application for cancellation of the bail. Miscellaneous applications pending, if any, shall stand closed. 9.
