This is the 1st bail application filed under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail to the Applicant who is apprehending his SAURABH YADAV Digitally signed by SAURABH YADAV Date: 2026.07.13 11:24:06 +0530 2 arrest in connection with Crime No. 1340/2025 registered at Police Station – Civil Lines, District- Bilaspur (C.G.), for the offences under Section 303 (2) of BNS. 2. That, as per prosecution story, on 21-01-2026, the complainant namely Deepak Sahu had lodged oral complaint before the police station alleging that on 08-11-2025 at about 11:00 AM he went to study at Kalpvriksh Library situated at Mangla and parked his motorcycle Pulsar bearing vehicle No.CG10 BY 1627, thereafter at night about 09:30 PM when he came back he found that his motorcycle is not present on the place. Based on the complaint, the police registered the crime against unknown person. Copy of the First Information Report is being filed as Annexure A-2. Hence, this bail application. 3. Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present case. He submits that there is no evidence to show the involvement of the applicant as on the date of incident, the applicant was not present in District: Bilaspur. He further submits that there is no article seized from the possession of the applicant, charge-sheet has not yet been filed, therefore, he prays for grant of anticipatory bail to the applicant. 3 4. On the other hand, learned State Counsel opposes the application and submits that there are 2 cases of similar nature registered against the applicant, which are still pending, therefore, the present bail application of the applicant be rejected. 5. Having heard learned counsel for the parties and upon perusal of the case diary, this Court finds that there are previous cases of similar nature which have been registered against the applicant, he is a habitual offender and charge sheet has not yet been filed. Considering the nature and gravity of the offence, the allegations regarding the applicant's involvement in the crime in question, this Court is of the opinion that is not a fit case to enlarge the applicant on regular bail. 6. Accordingly, the bail application of the applicant – Hariom Joshi involved in Crime No.1340/2025 registered at Police Station – Civil Lines, District- Bilaspur (C.G.), for the offences under Sections 303 (2) of B.N.S. is hereby rejected. 7.
