By the present writ petition, the petitioner seeks direction upon the respondent authorities for issuance of appointment letter to the petitioner as per letter dated 24th May, 2023 (Annexure P/12) for his appointment on compassionate ground. 2. Mr. Timir Baran Saha, learned advocate appearing on behalf of the petitioner submits that the petitioner has been empanelled for appointment on compassionate ground. However, as the vacancy status under Group ‘C’ category has not been forwarded by the District Inspector of Schools, Secondary Education, Murshidabad, the Commission is unable to take further steps. 3. Mr. Sunit Kr. Roy, learned advocate appearing on behalf of the West Bengal Regional School Service Commission submits that the District Inspector of Schools (S.E.), Murshidabad ought to forward the vacancy status under Group ‘C’ category to Commissioner of School Education. Since such vacancy status has not been forwarded, the consequential steps could not be taken for appointment of the petitioner. 4. Ms. Koyeli Bhattacharyya, learned advocate appearing for West Bengal Board of Secondary Education also submits that until and unless the vacancy status is forwarded by the concerned authority, the appointment letter cannot be issued. 5. In view of the above submissions, the District Inspector of Schools (S.E.), Murshidabad is directed to forward the vacancy status under Group ‘C’ category to the Commissioner of School Education within a period of six weeks from the date of communication of this order as per the availability of the vacancy. Upon the receipt of such vacancy status, respondent authorities concerned shall take all consequential steps within a period of four weeks thereof. 6. With the aforesaid direction, the writ petition being WPA 10479 of 2024 stands disposed of 2 7. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted 8. Interim order, if any, stands vacated. 9. All connected applications, if any, stand disposed of. 10. There shall be no order as to costs. 11. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court. 12.
