Report submitted by the learned advocate appearing for the State along with the acknowledgement of the private opposite party no.2/de facto complainant be kept with the record. Memo of Evidence submitted on behalf of the State be also kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than eight years and till date, only 8 witnesses have been examined out of 12 witnesses cited by the prosecution to prove its case. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. 2 I have taken into account the totality of the circumstances including the period for which the petitioner is detained. Having regard to the same, I direct the learned Trial Court to release the present petitioner viz., Sukumar Das on bail on such terms and conditions as the learned Trial Court deems fit and proper. As such, prayer for bail of the petitioner is allowed. However, the learned Trial Court, at the same time, would ensure that examination of rest of the witnesses proposed to be cited by the prosecution is completed within a period of six months from the date of communication of this order. The application for bail, being CRM (M) 913 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
