1. Since the aforesaid bail applications arise out of the same crime number, they are being heard and decided by this common order. 2. The present is the first application for grant of regular bail filed by the applicants under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, "BNSS").
The applicants have been arrested in connection with Crime No. 286/2025 registered at Police Station New Rajendra Nagar, District Raipur (C.G.), for the offences punishable under Sections 21(b) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 4

The prosecution case, in brief, is that on 22.12.2025, acting upon a credible information received at Police Station New Rajendra Nagar, Raipur, that the applicant/accused Aman Sharma and other co-accused were illegally possessing and selling brown sugar from a house situated at Varun Apartment, Block-B, Room No. 501, Amlidih, Raipur, the police conducted a raid after complying with the mandatory provisions of the NDPS Act. During the raid, the applicant and the co-accused were apprehended, and on their personal search, separate quantities of brown sugar, along with cash alleged to be sale proceeds and mobile phones, were recovered and seized from their conscious possession. The seized contraband from each accused was of non-commercial quantity. 4. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the present case. It is contended that the contraband allegedly seized from the applicants falls within the intermediate quantity under the provisions of the NDPS Act. It is further submitted that the applicants, namely Aman Sharma and Shubham Shingnapure @ Aryan have been in judicial custody since 23.12.2025, whereas the applicants, namely Mohammad Majid and Nandlal Thakur, have been in custody since 24.12.2025. It is also submitted that the applicants have no criminal antecedents. The investigation has been completed and the charge-sheet has already been filed. 5 Since the conclusion of the trial is likely to take considerable time, it is prayed that the applicants be enlarged on bail. 5.
Learned State counsel opposes the prayer for grant of bail and submits that, although the contraband allegedly seized is of intermediate quantity and the applicants have no criminal antecedents, considering the nature and gravity of the allegations and the material collected during the course of investigation, the applicants are not entitled to be released on bail. It is further submitted that the charge-sheet has already been filed. Accordingly, it is prayed that the bail applications be rejected. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Taking into consideration the facts and circumstances of the case, the entire material available on record, this Court finds that the contraband allegedly seized from the applicants falls within the intermediate quantity under the provisions of the NDPS Act. The applicants have no criminal antecedents and have been in judicial custody since 23.12.2025 and 24.12.2025, respectively. The investigation has been completed and the charge-sheet has already been filed. Consequently, their further custodial interrogation is not required. Considering the aforesaid facts and circumstances, the period of incarceration undergone by the applicants and the fact that the conclusion of the trial is likely to take considerable time, this Court is of the opinion that the
6 applicants have made out a case for grant of regular bail. Accordingly, without expressing any opinion on the merits of the case, the bail applications deserve to be and are hereby allowed. 8. Let the applicants, namely Mohammad Majid, Aman Sharma, Nandlal Thakur and Shubham Shingnapure @ Aryan, involved in Crime No. 286/2025 registered at Police Station- New Rajendra Nagar, District Raipur (C.G.), for the offences punishable under Sections 21(b) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, be released on bail on their furnishing personal bonds to the satisfaction of the Court concerned.
The applicants Mohammad Majid and Nandlal Thakur shall furnish two local sureties each in the like sum, whereas the applicants Aman Sharma and Shubham Shingnapure @ Aryan shall furnish two sureties each in the like sum, to the satisfaction of the Court concerned, subject to the following conditions:- (i) The applicants shall file an undertaking to the effect that they shall not seek any adjournment on the dates fixed for evidence when the witnesses are present in court. In case of default of this condition, it shall be open for the trial court to treat it as abuse of liberty of bail and pass orders in accordance with law. 7 (ii) The applicants shall remain present before the trial court on each date fixed, either personally or through their counsel. In case of their absence, without sufficient cause, the trial court may proceed against them under Section 269 of Bharatiya Nyaya Sanhita. (iii) In case, the applicants misuse the liberty of bail during trial and in order to secure their presence, proclamation under Section 84 of BNSS. is issued and the applicants fail to appear before the court on the date fixed in such proclamation, then, the trial court shall initiate proceedings against them, in accordance with law, under Section 209 of the Bharatiya Nyaya Sanhita. (iv) The applicants shall remain present, in person, before the trial court on the dates fixed for (i) opening of the case, (ii) framing of charge and (iii) recording of statement under Section 351 of BNSS. If in the opinion of the trial court absence of the applicants is deliberate or without sufficient cause, then it shall be open for the trial court to treat such default as abuse of liberty of bail and proceed against them in accordance with law. 9. However, this Court hopes and trusts that the trial Court shall make an earnest endeavour to conclude the trial expeditiously
8 from the receipt of this order in accordance with law, if there is no legal impediment.
10. Office is directed to send a certified copy of this order to the trial Court for necessary information and compliance forthwith. -
