1. The petitioner has filed the instant petition for following reliefs:-
“10.1 grant an immediate order of stay on the execution of the eviction order dated 30.03.2026 passed by the Tehsildar, Tilda-Nevra and the appellate order dated 23.06.2026 passed by the SDO (Revenue), Tilda-Nevra in Appeal Case No. 202604115000009/A-70/Year 2025-26; 10.2 direct the Respondents to maintain status quo with regard to the Petitioner’s possession over the land in dispute and not to interfere with or obstruct the same for a period of 30 days; 10.3 grant the Petitioner a period of 30 days to avail his statutory remedy of Second Appeal/Revision before the competent higher forum, during which period the eviction warrant shall not be executed; 10.4 pass such other order(s) or grant such other relief(s) as this Hon’ble Court may deem just and proper in the facts and circumstances of the case; 10.5 Award the costs of this petition in favour of the Petitioner and against the Respondents.”
2. Learned counsel for the petitioner submits that the petitioner may be granted 15 days' time to avail the appropriate statutory remedy by filing an appeal/revision before the Commissioner, Raipur. It is further prayed that, till the expiry of the said period, the respondent authorities be
directed not to take any coercive steps against the petitioner. Hence, the present petition.
3. Learned counsel for the State submits that the petitioner's appeal has already been dismissed by the S.D.O., who affirmed the eviction order dated 30.03.2026 passed by the Tahsildar in Revenue Case No. 202504110300072/A-70, Year 2024-25. It is further submitted that,
3 instead of approaching this Court, the petitioner ought to have availed the statutory remedy of appeal within the prescribed period of limitation. However, the petitioner failed to do so.
4. Heard learned counsel for the parties and perused the material available on record.
5. Having heard learned counsel for the parties, considered their rival
submissions, and upon perusal of the material available on record, this Court is of the considered opinion that the ends of justice would be served by granting the petitioner a limited opportunity to avail the statutory remedy available under law. Accordingly, the petitioner is granted 15 days' time to file an appropriate appeal/revision before the competent Commissioner along with an application for grant of interim stay. In the event such appeal/revision is preferred within the aforesaid period, the concerned Commissioner shall consider and decide the application for interim relief, as well as the appeal/revision, in accordance with law. Till the expiry of the said period of 15 days, the respondent authorities shall not take any coercive steps against the petitioner.
