This is the First bail application filed under Section 483 of Bharatiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail to the applicants who have been arrested in connection with Crime No. 385/2025 registered at Police Station – Bodhghat District Bastar (C.G.), for the offence punishable under Sections 20(b)(ii)(c) of N.D.P.S. 2. As per the prosecution story, is that on 25.08.2025, upon receiving secret information from an informer, the police of Police Station Bodhghat conducted a search. During search about 21.664 Kilogram of contraband Cannabis (Ganja) was allegedly recovered from the joint possession of the present applicants. Based on these allegations, the aforesaid offence was registered against the present applicants. Hence this application. 3. It has been argued by the learned counsel for the applicants that the applicants are innocent and have been falsely implicated in this case. He further submits that the charge-sheet has been filed and the applicants are in jail since 25.08.2025. He further submits that two witnesses have been examined out of 19 witnesses. The conclusion of the trial is likely to take some time, therefore, he prays for grant of bail. 4. On the other hand, the learned counsel for the State opposes the bail application and submits that the quantity of 21.664 Kgs Ganja has been seized from the joint possession of the applicants, which is much more than the commercial quantity. Further, the charge- sheet has been submitted. Hence, their bail application are liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6.
Taking into consideration the fact that quantity of contraband article i.e. 21.664 Kgs Ganja, which is much more than the
3 commercial quantity and the applicants have failed to give any explanation for the same and it cannot be said to be a case of false implication, further the charge-sheet has been submitted and the trial is in progress, the bail application of applicants – Poonam Kashyap and Rohit Bharti involved in Crime No. 385/2025 registered at Police Station – Bodhghat District Bastar (C.G.), for the offence punishable under Sections 20(b)(ii)(c) of N.D.P.S. Act, is rejected at this stage. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8.
