1. Affidavit-of-service filed in Court today is taken on record. 2. The petitioner had applied for the post of Assistant Professor in Life Long Learning & Extension (REC) in the Visva Bharati University pursuant to their Advertisement No. 02/2025 dated 29.05.2025. The post for which the petitioner applied had a single vacancy which was assigned to the reserved category (OBC). 3. The petitioner had made the application on June 26, 2025, however, without the requisite OBC certificate as stipulated in Clause 9 of the advertisement. Clause 9 is amply clear that the valid NCL-OBC certificate would have to be issued on or after April 1, 2025 to be considered as a valid document of a candidate. Certificates prior to April 1, 2025 would not be considered as a valid document. 4. Though the petitioner had been considered for the post, she was ultimately rejected since she did not have a valid certificate signifying that she belonged to the reserved category- OBC. The certificate appended to this writ petition is of April 6, 2026, much beyond the date when the application form had to be submitted i.e. June 30, 2025. Thus, the petitioner had
2 submitted a form which was incomplete and clearly not in consonance with the requirements as stipulated in the advertisement. It is on this ground alone that the petitioner’s application has been rejected by the authorities. 5. The petitioner submits that she had been a candidate of the OBC category since long and even though she had applied, the fresh caste certificate was not issued to her within time to enable her to file the same along with the application form. However, there is no reservation made by the petitioner nor any leave sought for while submitting the application form for the post of Assistant Professor. The certificate submitted by the petitioner along with the application form was one prior to April 1, 2025 and could not be construed or considered as a valid certificate to enable the petitioner to be considered for such a reserved category post. 6.
The Visva Bharati University by its Provisional Screening Committee Report of May 15, 2026 rejected the candidature of the petitioner on the ground that she did not have a valid caste certificate or at least she did not submit a valid caste certificate. 7. I find the rejection to be completely in consonance with the requirements mandated with the advertisement and any dereliction thereof would result in the petitioner getting a special treatment from others who appeared in the list of May 15, 2026. All other rejections (20 in number) are on the basis of invalid caste certificates. Thus, there is no reason why the petitioner’s case should be considered in any other light than those who appeared in that list of May 15, 2026. 8. The petitioner has also approached this court at a rather belated stage since the interview is to be held on July 9, 2026
3 and the Provisional Screening Committee Report had been published on May 15, 2026. This writ petition of July 1, 2026 at a belated stage is nothing but a chance taken by an opportune litigant. 9. I find no reason to interfere with the decision taken by the Visva Bharati University. 10. In view thereof, WPA 15217 of 2026 fails and is accordingly, dismissed. 11. There shall be no order as to costs. 12. Urgent Photostat certified copy of this order, if applied for, be given to the parties on usual undertaking. (Reetobroto Kumar Mitra, J.)
