1. Heard. 2. This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:-
“10.1 That, this Hon’ble Court may kindly be pleased to call for the records from the concerned authorities for its kind perusal. 10.2 That, the Hon’ble Court may kindly be pleased to issue a writ in the nature of mandamus or to issue appropriate direction, quashing the impugned letter dated 18.06.2026 and the petitioner is allowed to reside in the house constructed in part of Khasra No.58 area 1.708 hectare, i.e., 33 x 12 = 396 sq. Ft. situated at Village Pali, Tahsil Masturi, District Bilaspur (C.G.). 10.3 That, Hon’ble Court may kindly further be pleased to stay the effect and operation of letter dated 18.06.2026 issued by the Tahsildar Masturi, District Bilaspur (C.G.) till DEEPTI JHA Digitally signed by DEEPTI JHA
2 disposal of the case in the interest of justice. 10.4 That, any other relief which the Hon’ble Court deems fit and proper as per the nature of the case.”

Learned counsel for the petitioner submits that notice dated 18.06.2026 has been served upon the petitioner for removal of encroachment of the petitioner till 25.06.2026, from the land bearing Khasra No.58 area 1.708 hectare, i.e., 33 x 12 = 396 sq. Ft. situated at Village Pali, Tahsil Masturi, District Bilaspur (C.G.), which is a grass land. When the encroachment was not removed, another notice was issued on 08.07.2026 to the petitioner. 4. Learned State counsel submits that petitioner may approach before the competent Court. 5. I have heard learned counsel for the parties and perused the material available on record. 6.
From perusal of the aforesaid notice order, it appears that an order dated 10.06.2026 has been passed by the Tehsildar, Masturi against the petitioner. The petitioner ought to have challenged the said order before the competent Court of law. 7. Considering the aforesaid aspect of the matter, this petition is disposed of, directing petitioner to file an appropriate appeal against the order dated 10.06.2026 passed by the Tehsildar, Masturi in accordance with law within a period of 15 days from today. 8. Till 15 days, the respondent No.3/Tehsildar, Masturi is directed not to take any coercive steps against the petitioner. 9. With aforesaid observation and direction, this writ petition stands disposed of. 10. Interlocutory application(s), pending if any, also stands disposed of. Sd/- (Amitendra Kishore Prasad)
