The petitioner who is the Pradhan of Pokharia Gram Panchayat has challenged the notice issued by the Prescribed Authority on 24th June, 2026 fixing the date of meeting on 3rd July, 2026 on the ground that clear 7 days’ notice as prescribed under Section 12(3) of the West Bengal Panchayat Act, 1973 was not given. It appears from the notice that it was issued on 24th June, 2026 fixing the date of meeting on 3rd July,
2026. Section 12(3) of the Act stipulates sending of notice of meeting at least before clear 7 days of the meeting. The notice issued by the Prescribed Authority is in conformity with the said provision of law and is, therefore, legal and valid.
Learned counsel for the private respondents/requisitionists produces a letter issued by the Prescribed Authority on 2nd July, 2026 which demonstrates that the meeting scheduled to be held on
2 3rd July, 2026 was postponed due to pendency of the present writ petition. In view of the fact that the notice dated 24th June, 2026 was issued in accordance with law and the meeting scheduled to be held on 3rd July, 2026 has been subsequently postponed, the writ petition is devoid of any merit and accordingly dismissed. In view of the time frame laid down under Section 12 of the Act of 1973, the Prescribed Authority and the Block Development Officer, Goalpokher-I Development Block, being the 2nd respondent herein, is directed to convene the meeting within 5 days in terms of Section 12(3) of the Act and take the proceeding to its logical conclusion in accordance with law. The Officer in Charge, Goalpokher Police Station is directed to render necessary assistance to the 2nd respondent so that the meeting is held peacefully and without any disturbance from any corner whatsoever. Copy of the order be given to the Prescribed Authority and the Officer in Charge, Goalpokher Police Station by the State and the private respondents at once. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
