07.07.2026 IN THE HIGH COURT AT CALCUTTA Item No.13 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 983 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Krishnaganj Police Station Case No. 336 of 2024 dated 31.08.2024 under Sections 65(1)/351(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 6 of the Protection of Children from Sexual Offences Act, 2012. And In Re : Nakul Sardar @ Nukul Sarder ... Petitioner. Mr. Prabir Majumder, Mr. Snehansu Majumder, Ms. Sangeeta Chakraborty, Ms. Anindita Kundu ... For the Petitioner. Ms. Koel Mukherjee ... For the State. Report submitted by the learned advocate appearing for the State along with the acknowledgement of the private opposite party no.2/de facto complainant be kept with the record. Memo of Evidence submitted on behalf of the State be also kept with the record. Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 9 months and till date, 10 witnesses have been examined out of 14 witnesses cited by the prosecution. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that next date has been fixed for evidence of CSW-10. 2 I have taken into account the medico-legal examination of the victim as well as the statement recorded under Section 164 of the Code of Criminal Procedure. Having considered the totality of the circumstances, I am of the opinion that some opportunity must be given to the prosecution to complete the evidence of the case. As such, the prosecution is directed to complete the examination of rest of the witnesses within a period of six months from the date of communication of this order. Learned Trial Court would ensure that at the earliest, the trial of the case is completed. At this stage, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 983 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
