This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 12184 of 2025 to its original file. Learned counsel for the petitioner submits that B.A. No. 12184 of 2025 was dismissed for non-compliance of the peremptory order of filing supplementary affidavit. It is next submitted that due to unavoidable circumstances, the petitioner could not collect the complete particulars of criminal antecedent against the petitioner hence the said supplementary affidavit could not be filed within the stipulated time and for non-filing of which B.A. No. 12184 of 2025 was dismissed. It is further submitted that non-compliance of peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 12184 of 2025 and unless B.A. No. 12184 of 2025 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 12184 of 2025 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 12184 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
