2 COMMON ORDER: Criminal Petition has been filed under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023 (for brevity the ‘BNSS’) by the Petitioner/Accused No.2, seeking to quash the proceedings against him in S.C.SPL.No.80 of 2025 on the file of the learned VIII Additional District and Sessions Judge- cum-Special Judge for Trial of cases under SC’s & ST’s (POA) Act Cases, West Godavari at Eluru for the offences under Sections 506 read with 34 of the Indian Penal Code, 1860 (for brevity ‘the IPC’), and Sections 3(1)(r)(s), 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for brevity ‘the SC’s & STs (POA) Act’). 2. 4. On 12.12.2025, a learned Single Judge of this Court recorded the presence of the Petitioner and Respondent No.2 and they were identified by their respective Counsel in open Court. 5. Ms.
P.Akhila Naidu, learned Assistant Public Prosecutor for the State, reported no objection to record the compromise. 6. This Court is conscious of the legal position that the offences alleged under ‘the SC’s & STs (POA) Act’ are not compoundable in terms of the statutory scheme. However, the bar on compounding does not preclude the exercise of inherent powers of this Court under Section 528 of ‘the BNSS’ to secure the ends of justice, particularly when the de‑facto complainant and the accused have voluntarily resolved their dispute without any coercion. The Hon’ble Supreme Court has consistently held that even in cases involving non‑compoundable offences, the High Court may quash the proceedings when the compromise is genuine, the continuation of prosecution would serve no useful purpose, and the matter is essentially personal in nature, as per the
judgment of the Hon’ble Apex Court in Ramawatar v.State of Madhya Pradesh1.
7. In the present case, as the parties have amicably settled their dispute and the de‑facto complainant has clearly expressed that he does not wish to pursue the case, this Court finds sufficient justification to accept the compromise and to quash the proceedings. 1AIROnline 2021 SC 927

8. Consequently, the Interlocutory Application Nos.3 & 4 of 2025 seeking permission to compromise and to record the same are liable to be allowed and
disposed of accordingly.
9. Accordingly, Criminal Petition is allowed, and the case against the accused in S.C.SPL.No.80 of 2025 on the file of the learned VIII Additional District and Sessions Judge-cum-Special Judge for Trial of cases under SC’s & ST’s (POA) Act Cases, West Godavari at Eluru, is hereby quashed. As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed. _________________________ Dr. Y. LAKSHMANA RAO,J Date : 31.01.2026 VTS
