HC-KAR NC: 2026:KHC:33669 WP No. 28901 of 2025
ORAL ORDER
The petitioner's grievance is with the construction by the third respondent without any setback. The petition is filed in the month of September 2025 and is listed on multiple occasions for businesses such as non-compliance with office objections, and this Court has also recorded absence on behalf of the petitioner on 01.04.2026.
The question is: should this Court issue notice at this stage when it is probable that the third respondent has completed the construction? This Court opines that if the petitioner is not diligent in pursuing the cause, the same must lapse, and therefore, the petition must be disposed of but with the observation that this disposal cannot foreclose the pending proceedings or any other proceedings that may be permissible in law against deviations in the construction.
